My wife was deported by ice a few days before the immigration granted her motion of reopen and reconsider?
Well, I doubt very much immigration will allow her permission to reenter the US at this point based on this tardy motion to reopen. Had permission come in before she was deported, it would probably still be difficult, but you would have had something to discuss in any case. So, all you can do for now is have her I-130 immigrant petition sent overseas so she can get an immigrant visa interview and then she can apply for a waiver. You can try to get this overturned with an attorney, but it will be faster and certainly cheaper to simply go the visa interview route at this point. Plus, if you're turned down, you'll lose whatever time is lost in reaching that decision, as they won't transfer the petition while the decision is pending.
